Terms of Use

1. The agreement
These terms, together with Apple's Licensed Application End User License Agreement (the “Standard EULA”), govern your use of the PlantWiz app and PlantWiz Pro. PlantWiz is published by Anas Alradhwan, an independent developer based in Kuwait and the seller shown on its App Store page (“we”, “us”). By using PlantWiz you agree to these terms. Our Privacy Policy explains how we handle data. If these terms and the Standard EULA conflict, the Standard EULA governs your licence to use the app itself, and these terms govern the PlantWiz service (identifications, health checks and PlantWiz Pro).
18 and over only. PlantWiz is for people 18 and over only. By using PlantWiz you confirm that you are at least 18 years old.
2. What PlantWiz does, and what it doesn't
PlantWiz uses automated image recognition to suggest what a plant is and whether it shows signs of a problem, and it offers care and treatment tips. Identifications and health results are automated estimates. They can be wrong and are not professional advice (botanical, agricultural, medical or veterinary). Check important decisions with a qualified professional.
Never eat, drink, touch or give a plant to a person or animal because of a result in PlantWiz. PlantWiz is not a guide to foraging or edibility.
3. Toxicity information
Toxicity notes are general guidance only and may be incomplete or wrong. A plant without a warning is not necessarily safe.
If a pet or a person may have eaten a plant, contact a vet or a poison control centre right away. In the US: Poison Help 1-800-222-1222, or the ASPCA Animal Poison Control Center (888) 426-4435 (a fee may apply). Elsewhere, call your local emergency number or poison centre.
4. PlantWiz Pro subscriptions
- Plans. PlantWiz Pro is offered as a yearly subscription, with a 7-day free trial when you are eligible, and as a weekly subscription. Prices are shown in the app, in your local currency, before you buy, and may vary by country.
- Payment. Payment is charged to your Apple Account when you confirm the purchase or, with a free trial, when the trial ends.
- Auto-renewal. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Free trial. Apple decides trial eligibility. To avoid being charged, cancel at least 24 hours before the trial ends. Any unused part of a free trial ends when you buy a subscription.
- Manage or cancel. Open Settings on your iPhone, tap your name, then Subscriptions. After you cancel, Pro stays active until the end of the period you paid for.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com).
- Restore. If you reinstall PlantWiz or change phones, tap “Restore” at the bottom of the paywall, or “Restore purchases” on the PlantWiz Pro card in the Me tab.
5. Free scans and fair use
The free version includes a limited number of scans. PlantWiz Pro includes up to 20 scans an hour and 60 a day (fair use), which keeps the service fast and prevents abuse. Normal use doesn't reach these limits.
6. Your photos
Only scan photos you have the right to use. When you scan a photo, you allow us and our identification provider, Kindwise s.r.o., to process it to provide the service. Under Kindwise's terms, Kindwise also receives a non-exclusive, irrevocable licence to use photos it receives, for example to improve its models and to show them to other users as similar images, with faces blurred. Don't scan photos of people, documents or anything private.
7. Acceptable use
Please use PlantWiz lawfully and fairly. You may not:
- upload unlawful, harmful or infringing content;
- copy, decompile or reverse engineer the app, except where the law allows it;
- use bots, scripts or other automated or bulk access, or try to get around scan limits, the paywall or security checks;
- use PlantWiz or its results to build or train a competing identification service, or resell them.
8. Third-party content
Some plant descriptions come from other sources, such as Wikipedia (licensed under CC BY-SA). The source is shown under each description (for example “Source: Wikipedia (CC BY-SA)”), and its licence applies. Look-alike photos on a result are credited under each photo with their licence and, where one is given, their author, and those licences apply. Where a plant grows, its plant type and its native climate are adapted from the World Checklist of Vascular Plants: Govaerts R (ed.), WCVP: World Checklist of Vascular Plants, facilitated by the Royal Botanic Gardens, Kew (doi.org/10.15468/6h8ucr), and Govaerts R, Nic Lughadha E et al., The World Checklist of Vascular Plants, a continuously updated resource for exploring global plant diversity, Scientific Data 8, 215 (2021) (doi.org/10.1038/s41597-021-00997-6), licensed under CC BY 3.0. We adapted it: we kept accepted names and their synonyms, dropped doubtful records and grouped areas by the TDWG World Geographical Scheme for Recording Plant Distributions, level 3 (Brummitt 2001). The globe's map shapes come from Natural Earth (public domain). The app credits both on the screen that uses them.
9. Changes to the app and these terms
We keep improving PlantWiz, so features may change. The service may occasionally be unavailable. We may update these terms; the date at the top shows the latest version, and for important changes we will also tell you in an app update.
10. Disclaimers and liability
PlantWiz is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, or for the loss of plants, crops or property resulting from use of the app, and our total liability for any claim is limited to the amount you paid for PlantWiz Pro in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that can't be limited.
11. Ending
You can stop using PlantWiz at any time and delete your data in Me → Delete my data. We may suspend access in cases of abuse or a breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Kuwait. If you use PlantWiz as a consumer, this doesn't take away the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts where you live when that law allows it.
